Asphalt Aesthetics Club provides a limited workmanship warranty of one (1) year on crack repair services only. This warranty applies strictly to cracks that were filled or repaired by Asphalt Aesthetics Club and is valid from the date of project completion.
If a crack that was repaired by Asphalt Aesthetics Club fails within one (1) year under normal conditions, Asphalt Aesthetics Club may, at its sole and absolute discretion, return to re-fill or address the affected crack area.
This warranty is limited strictly to the original repaired cracks and does not apply to new cracks, surrounding areas, or any structural movement. No other warranty is provided except as expressly stated herein.

Warranty, Exclusions & Limitations
This warranty is:
- Limited strictly to crack repair workmanship only
- Non-transferable
- Valid only where the project has been paid in full
- Void in the event of non-payment, partial payment, or late payment
- Void where the surface is altered, disturbed, or modified after completion
No Warranty Coverage
1. No Warranty on Sealing
Asphalt Aesthetics Club provides no warranty, guarantee, or assurance on:
- Asphalt sealing
- Sealcoat performance
- Colour, shade, or finish consistency
- Fading, wear, or oxidation
- Tire marks, scuffing, or tracking
- Peeling, flaking, or uneven application
- Surface texture or visual appearance
Sealing is a maintenance service only. Results vary based on weather, traffic, and existing surface conditions.
2. No Warranty on Asphalt Work
No warranty is provided for any asphalt-related work, including but not limited to:
- Pothole repairs
- Asphalt patching
- Infrared repairs
- Catch basin adjustments or repairs
- Tie-ins or transitions
- Utility cuts or reinstatements
- Any repair or partial restoration work
All asphalt work is performed on existing surfaces and conditions beyond the control of Asphalt Aesthetics Club. Performance and longevity cannot be guaranteed.
3. Repairs & Patchwork Disclaimer
All repair, patchwork, and remedial work is performed on a non-warranty basis, unless explicitly stated otherwise in writing. Repairs do not involve full reconstruction and may:
- Settle
- Shift
- Crack
- Deteriorate over time
These outcomes are normal and not considered defects.
4. Existing Surfaces & Pre-Existing Conditions
No warranty is provided on any existing asphalt surface not fully reconstructed by Asphalt Aesthetics Club. Asphalt Aesthetics Club is not responsible for:
- Pre-existing cracks
- Structural deficiencies
- Base failure
- Previous repairs
- Aged or deteriorated asphalt
- Unknown or hidden conditions
Conditions Beyond Control
Asphalt Aesthetics Club shall have no responsibility or liability for any condition, damage, or failure caused in whole or in part by factors beyond its control, including but not limited to:
- Freeze-thaw cycles
- Winter conditions
- Seasonal movement
- Frost or heaving
- Settlement or sinking
- Soil expansion or contraction
- Heavy traffic or turning vehicles
- Excessive heat or UV exposure
- Rain, snow, or ice
- Water penetration or drainage issues
- Oil, fuel, or chemical spills
- Tree roots or vegetation
- Animals or insects
- Utility failures or underground issues
- Third-party work or interference
- Vibrations or nearby construction
- Acts of God
None of the above shall be considered a workmanship defect.
Subcontracted & Exterior Work
For any work subcontracted or performed by third parties, including any outdoor or exterior construction services:
- The warranty (if any) shall be strictly limited to what is explicitly stated in the written contract
- If a warranty is provided in the contract, that warranty shall apply as written
- If no warranty is stated, then no warranty is provided
- Asphalt Aesthetics Club assumes no responsibility or liability beyond the written contract
All claims must be directed in accordance with the applicable contract.
Materials Disclaimer
Asphalt Aesthetics Club does not manufacture any materials used and provides no warranty on materials. Any manufacturer warranty, if applicable, must be handled directly with the supplier.
Site Access & Equipment Disclaimer
The client acknowledges that work may require the use of equipment and machinery. Asphalt Aesthetics Club shall not be responsible for:
- Damage to lawns
- Surface markings
- Access-related wear
- Disturbance to surrounding areas unless otherwise stated in writing
Colour & Finish Variations
All asphalt and sealcoat work may vary in:
- Colour
- Shade
- Texture
- Finish
Uniform appearance is not guaranteed.
Concealed / Unforeseen Conditions
All work is based on visible site conditions at the time of inspection. Asphalt Aesthetics Club is not responsible for:
- Hidden damage
- Subsurface failure
- Buried debris
- Poor base conditions
- Unknown site issues
Any additional work required will be extra.
Drainage & Water Disclaimer
Asphalt Aesthetics Club does not guarantee drainage performance unless specifically included in writing. The company is not responsible for:
- Standing water
- Pooling
- Runoff issues
- Ice formation
Third-Party Interference
Any work that is modified, repaired, sealed, pressure washed, or altered in any way by any third party will immediately void all warranties.
Right to Suspend or Terminate
Asphalt Aesthetics Club reserves the right to suspend or terminate work in the event of:
- Non-payment
- Unsafe conditions
- Client interference
- Misrepresentation of site conditions
All completed work remains payable.
Client Conduct & Breach
Asphalt Aesthetics Club reserves the right to refuse or terminate service in cases of:
- Verbal abuse
- Threatening or aggressive behaviour
- Interference with work
- Dishonesty or misrepresentation
Termination results in immediate cancellation of warranty and immediate payment due for completed work.
Claim Procedure
All claims must be submitted in writing. Asphalt Aesthetics Club reserves the sole right to:
- Inspect the work
- Determine validity
- Approve or deny claims
- Determine repair method and timing
Repairs may be delayed due to weather or seasonal conditions.
Limitation of Liability
To the fullest extent permitted by law, Asphalt Aesthetics Club shall not be liable for:
- Indirect or consequential damages
- Loss of use
- Loss of business or income
- Property damage
- Additional repair costs
Indemnification
The client agrees to indemnify and hold harmless Asphalt Aesthetics Club from any claims arising from:
- Site conditions
- Misuse
- Lack of maintenance
- Third-party interference
Right to Modify Warranty
Asphalt Aesthetics Club reserves the right to modify, update, or terminate this warranty at any time.
